Dear Senator or Representative

On November 4, 2002, the case of Felter, et al. v. Norton, et al., Civ. No. 1:02CV02156 was filed in the U.S. District Court, District of Columbia. I am a plaintiff in this pending action. I urge you to become familiar with our case since it is also a spiritual battle to reclaim our identity as federally-recognized members of the Uinta Band. We are also committed to educating the public on a massive injustice that cannot be swept under the rug and forgotten.

Our lawsuit charges that the Bureau of Indian Affairs incorrectly implemented the "Ute Partition Act", a law enacted in 1954 to "terminate" our legal relationship with the U.S. government, and, as a consequence, this Act of Congress is null and void. There is no doubt that the Bureau of Indian Affairs bungled the implementation of the Ute Partition Act. There is also no doubt that we, as "mixed-blood" members of the Uinta Band of Utes, objected early on to our "termination" but we were forced by the Bureau of Indian Affairs into accepting the Act - our stringent objections to its passage kept from Congress by the U.S. government.

We intend that our legal action cause reflection by the world on years of systematic destruction of our tribal culture and the political and economic disenfranchisement that has isolated us from our homeland and left us the forgotten victims of an Act of Congress enacted on racial lines. The despicable federal policy of termination that continues to affect and scar us has been renounced except for my Native People, the "mixed-blood" Uinta Utes. Why?

We urge you to become familiar with our case. You will find that because of the bungled implementation of the Act, we were stripped of our tribal identity and our homelands and billions of dollars of assets were turned over to Ute Indian Tribe and non-Indians for their benefit - something that Congress never intended when the Ute Partition Act was forced upon us, our parents and grandparents in 1954.
